Dream Day Vacay

FAMILY’S Dream Day Vacay Voting Contest (the “Contest”)
OFFICIAL RULES (the “Voting Contest Rules”)

The Contest runs from 10:00 a.m. Eastern Time (“ET”) June 25, 2018 to 10:00 a.m. ET July 9, 2018 (the “Voting Contest Period”).


To enter the Contest, go to (the “Website”) and click on the "Dream Day Vacay" icon displayed in the “CONTESTS” section of the Website to access the Contest microsite. 

Click the “Vote” button to access the Contest voting entry form. The Contest voting entry form must be completed each time a vote is submitted.  Each eligible vote will be entered, for a chance to win the Prize. To submit a vote (i) enter your full name, age, city, province or territory, phone number and email address; (ii) select the Dream Day Vacay Finalist that you wish to vote for; and (iii) submit your completed voting entry form. A completed voting entry form from an eligible entrant will constitute one vote for the Finalist selected, and one entry into the Contest for the entrant.  A Contest voting entry form must be completed and submitted with each vote, or the vote will be disqualified.

The only method of voting/entry in this Contest is an online vote/entry (internet access required). Online voting/entry is available through the Website only; no other means of submission will be accepted. Although online access and an email account are required in order to participate, no purchase is required in order to enter the Contest. Many public libraries, retail businesses and others offer free access to computers and a number of Internet service providers and other companies offer free email accounts.

All eligible Contest votes/entries will be entered for a chance to win a Prize. 

(referred to herein as “Prize(s)”, or “Grand Prize(s)” as applicable)

There is one Grand Prize available to be won, consisting of: 

  • One $500.00 Transat Travel Gift Card

Approximate retail value of the Grand Prize is $500.00.  All amounts are in Canadian dollars. 

The Contest is open only to permanent lawful residents of Canada, excluding: (i) residents of Quebec under the age of 13; (ii) any person, or any person whose immediate family members (i.e., parents, children, spouse, siblings, grandparents, the “steps” of each and persons residing in such immediate family members' household), and persons with whom they are domiciled, has been declared a winner of another contest sponsored by DHX Television Ltd. (“Family” and the “Contest Sponsor”) within 90 days of the start of the Voting Contest Period; and (iii) employees, officers, directors, representatives, and agents (and their immediate family members of Family and its parents, subsidiaries and affiliates, and advertising and promotional agencies involved in this Contest. This Contest is subject to all federal, provincial, and municipal laws and regulations. Void where prohibited by law. Contest Sponsor with the consent of the Régie des alcools, des courses et des jeux (the “RACJ”), reserves the right to cancel or suspend this Contest in the event of any accident, or administrative or other error of any kind.

An entrant under the age of majority in his/her province of residence (a “Minor”) must have a parent or legal guardian consent to his/her participation. Proof of identification and parental consent must be provided upon request. If a parent or legal guardian does not provide consent, or if satisfactory proof of identification to confirm the winner’s (or the Minor winner’s parent/ legal guardian’s) identity and personal information provided in connection with the Contest, including but not limited to, the winner’s (or the Minor winner’s parent/ legal guardian’s) name and email address, cannot be obtained, the vote and entry will both be disqualified.

Entries must be received no later than 10:00 a.m. ET on July 9, 2018. Contest Sponsor takes no responsibility for entries that are lost, misdirected, delayed, garbled, incorrect, illegible or received after the Contest deadline. Limitone vote/entry per person, per day,in addition to a limit of four entries from the same household per day. Only one email address and account may be used by any person to enter the Contest.  In the event that Contest Sponsor receives more than the permitted number of entries, Contest Sponsor reserves the right to void and destroy any votes and entries from that entrant and household, and that entrant/household may, at the discretion of the Contest Sponsor, be disqualified from the Contest. Should it be discovered that an entrant is using the aid of computer programs to auto-fill votes or entries, that entrant will be immediately disqualified from the Contest. Contest Sponsor reserves the right to disqualify all such entrants from future contests conducted by the Contest Sponsor without further notice.

In the event of a dispute as to the identity of a winner based on an email address, the winning vote/entry will be deemed to be made by the authorized account holder of the email address at the time of vote/entry. The authorized account holder is the natural person who is assigned an email address by an Internet service provider or other organization responsible for assigning email addresses for the domain associated with the email address in question.

A random draw will be held at 12:00 p.m. ET on July 9, 2018 at Family’s office located at 207 Queens Quay West, Suite 550, Toronto, Ontario. There will be one Grand Prize draw to fulfill this Contest. The chances of being selected to win a Prize in this Contest depend on the total number of eligible votes/entries received.

A Family representative will notify the selected entrant, or the parent/legal guardian of the selected entrant who is a Minor, by telephone or email within ten days of the draw. The selected entrant will then have within fivedays following receipt of notification to contact Family and provide requested documentation to claim his/her Prize. Notification shall be deemed to have occurred, in the case of telephone notification, on the date that selected entrant, or in the case of a Minor, his or her parent or guardian, speaks with a representative of Family, or, in the case of email notification, the date the email is sent to the selected entrant’s email address by Family. It is the responsibility of the selected entrant or the selected Minor entrant’s parent/legal guardian to check his or her email account in a timely manner. Prior to being awarded a Prize, the entrant selected as a winner must correctly complete, unaided, a time-limited, mathematical, skill testing question and must sign a declaration and release form (“Declaration and Release”) confirming compliance with these Voting Contest Rules, his/her acceptance of the Prize as awarded; and acknowledging the non-responsibility of the Contest Sponsor,its parents, affiliates, subsidiaries, cable and satellite affiliates, associates, their respective promotional and advertising agencies, and each of their respective employees, officers, directors, agents, successors and assigns (the “Releasees”), with regard to any injury, accident, damage, claim, liability, loss or misfortune related to any aspects of the Contest, any Prize awarded, the acceptance, use, misuse, possession and delivery of a Prize, participation of winner in any Prize related activities, printing errors or claims based upon publicity rights, defamation or invasion of privacy. A Minor winner’s parent or legal guardian must sign the Declaration and Release on his/her behalf in order for the winner to claim his/her Prize.

The Declaration and Release must be signed and returned by July 24, 2018. Should Family be unable to contact the selected entrant by telephone or email, or should a selected entrantbe unable to correctly answer the skill-testing question or does not respond and complete the Declaration and Release by the deadline specified above, that selected entrant will be deemed to have forfeited any rights to the Prize and an alternate entrant will be selected in the same manner by random draw taken from the same pool of votes/entries, in which event, the foregoing provisions of this sentence shall also apply to such other eligible vote/entry. This process shall be repeated until such time as a selected entrant is confirmed to be a Prize winner or until there are no more eligible votes/entries, but in any event no later than August 30, 2018. All Prize taxes, if any, are the responsibility of the winner. Limit one Prize per household.

Contest Sponsor will not be held responsible for the loss of any Prize due to changes in mailing addresses, errors in completed votes/entry forms or any other circumstances leading to an invalid, erroneous or incomplete mailing address or email address.

Family or its appointed designee shall deliver Prizes to selected winner(s).

By submitting a vote/entry, each entrant (or Minor entrant’s parent or legal guardian on his/her behalf) agrees to be bound by these Voting Contest Rules.
All votes/entries become the property of Family and will not be returned.

Each Prize must be accepted “as is” and may not be exactly as shown. Contest Sponsor, in its sole discretion, reserves the right to substitute any portion of a Prize with a prize of equivalent or greater retail value. Some restrictions may apply. Prizes are non-transferable, non-refundable, non-negotiable and have no cash value. If the actual value of any Prize is less than the stated approximate retail value, the difference will not be awarded.  All Prize elements are subject to availability.

All incidental costs and expenses, including but not limited to, batteries and additional accessories, (the “Expenses”) not specifically mentioned herein as part of the Prize description are the sole responsibility of the Prize winner. The Prize winner shall not seek reimbursement for the Expenses from the Contest Sponsor.
Except where prohibited by law, Contest Sponsor does not make any representation nor offer any warranty, express or implied, as to the quality or fitness of the Prize(s) awarded in connection with the Contest. Each Prize winner (or parent/legal guardian of a Minor winner) understands and acknowledges that he or she may not seek reimbursement or pursue any legal or equitable remedy from the Contest Sponsor should the Prize fail to be fit for any purpose or is in any way unsatisfactory to a Prize winner.

By entering the Contest, each entrant agrees to waive all rights with respect to print and broadcast publicity. By entering the Contest and accepting a Prize, the winner or Minor winner’s parent or legal guardian hereby consents to the reasonable use by Contest Sponsor of the winner's name, age, photograph, voice, likeness and image, city and province/territory of residence, worldwide and in perpetuity, without any further compensation, for any future promotional activity in connection with this Contest.

By entering the Contest, each entrant agrees that the Releasees shall bear no responsibility whatsoever with regard to any claims, liability, damage, injury, accident, loss and misfortune related to any aspects of the Contest, the Prize, the acceptance, use, misuse, possession and delivery of the Prize, participation of winner in any Prize related activities, printing errors, claims based upon publicity rights, defamation or invasion of privacy. By consenting to a Minor entrant’s vote/entry into the Contest, the Minor entrant’s parent/legal guardian agrees to the foregoing on the Minor entrant’s behalf.

By entering the Contest and voluntarily providing personal information, each entrant (or the parent or legal guardian of a Minor entrant) consents and agrees to Family’s collection and use of the information provided by the entrant for the purpose of administering this Contest and, if consent is given at the time of voting/entry, to provide the entrant with marketing information relating to new and existing products and upcoming promotions of Family by mail or email. Your personal information will not be disclosed to any third party nor will you receive communications from the Contest Sponsor, unless your opt-in consent is received, in compliance with the Personal Information Protection and Electronic Documents Act, the “Act”) and its associated regulations, Canada’s Anti-Spam Law (CASL) and its associated regulations, and other applicable data protection and personal information protection laws. Contest Sponsor is not responsible for incorrect or inaccurate entry of registration or entry information which may affect an entrants’ inability to get through on the internet during the promotion or ability to participate in the Contest, including but not limited to human error, technical malfunctions, lost/delayed/corrupted data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software or any combination thereof, any inability to access the site, or damage to a user's system occasioned by participating in the Contest, and votes/entries which fail to fully comply with these Voting Contest Rules. 

Contest Sponsor reserves the right, in its sole and absolute discretion, and with the consent of the RACJ, to cancel, modify or suspend a contest for any reason, including without limitation in the event of any printing, administrative error, virus, bug, unauthorized human intervention or other causes beyond its control which corrupt or affect the administration, security, fairness or proper conduct of the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, Contest Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.  Votes/entries are subject to verification and will be declared invalid if they are forged, falsified, altered or tampered with in any way. Appropriate notice to the RACJ will be provided where necessary. Family and its sponsors are not responsible for preemption, cancellation, or interruption, in whole or in part, of any Family contest related programming.

For residents of Quebec, any litigation respecting the conduct or organization of a publicity contest may be submitted to the RACJ for a ruling. Any litigation respecting the awarding of a prize may be submitted to the RACJ only for the purpose of helping the parties reach a settlement.
